By using Backerz ("Backerz," "the Platform," "we," "us," or "the Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. What Backerz Is

Backerz is a digital marketplace where users can visit creator pages, buy digital content, and send gifts to creators.

Creators may offer free content, paid content, one-time unlocks, gift options, or other creator-specific digital benefits. The exact content, price, access terms, and any other purchase details are shown before checkout.

2. Accounts

You may need an account to use certain parts of the Service, including buying content, viewing protected content, managing your purchases, contacting support, or becoming a creator.

You are responsible for keeping your login details secure and for all activity under your account. You must not share, sell, transfer, or misuse your account.

We may suspend or terminate accounts that violate these Terms, abuse the Platform, create legal risk, or harm other users, creators, or Backerz.

3. Purchases, Gifts, and Access

Purchases on Backerz may provide access to digital content, creator pages, creator posts, or other digital benefits.

Gifts are voluntary payments made to support a creator. Unless clearly stated otherwise at checkout, gifts do not create a shipping, delivery, or redemption obligation beyond the digital benefit described on the Platform, if any.

Unless stated otherwise at checkout:

  • Access is granted immediately after successful payment.
  • Purchases are for personal, non-commercial use only.
  • Purchased access may not be shared, copied, resold, redistributed, leaked, scraped, downloaded in bulk, or publicly displayed.
  • Access may depend on your account remaining active and in good standing.
  • Creator content may change over time.

By completing a purchase, you acknowledge that access to digital content or digital services may begin immediately.

Where required by law, you may be asked to expressly agree that immediate access begins before the end of any withdrawal period and that you lose any withdrawal right once access has started or the digital content has been delivered.

4. No Refunds

All completed purchases are final and non-refundable unless required by applicable law.

This includes, but is not limited to:

  • Paid creator access
  • One-time content unlocks
  • Digital gifts
  • Lifetime access purchases
  • Purchases that were not completed as shown at checkout

No partial refunds are provided for unused access, creator bans, account bans, failure to use the Service, or dissatisfaction with creator content.

If there is a technical issue with access, billing, or delivery, you must contact Backerz support so we can investigate and attempt to resolve the issue.

5. Creator Content and Creator Control

Creators are responsible for the content they publish and the benefits they offer.

Backerz does not guarantee that a creator will post at a specific frequency, keep old posts available forever, maintain the same content style, or provide any benefit outside what is clearly shown on the Platform.

Creators may remove content, update their page, change their offering, or stop using the Platform. This does not automatically entitle users to a refund.

Creators may also remove or restrict a user from their creator page or content if the user violates creator rules, platform rules, or behaves abusively. If access is removed because of user misconduct, no refund will be issued.

6. User Conduct

You agree not to:

  • Share, leak, copy, redistribute, resell, or publicly display creator content.
  • Bypass access controls, payment systems, or platform restrictions.
  • Use another user’s account without permission.
  • Harass, threaten, abuse, impersonate, dox, spam, or exploit creators, users, or Backerz staff.
  • Upload or distribute unlawful, harmful, infringing, or abusive content.
  • Scrape, automate, reverse engineer, or interfere with the Platform.
  • File fraudulent, false, abusive, or bad-faith payment disputes.
  • Use the Service in any way that violates applicable law.

We may suspend, restrict, or permanently ban accounts that violate these rules. Banned users are not entitled to refunds for completed purchases or unused access unless required by law.

7. Support Requirement Before Payment Disputes

If you have a problem with a payment, access, login, creator page, or delivered content, you must contact Backerz support before opening a chargeback, bank dispute, or payment dispute.

Support allows us to:

  • Confirm whether access was delivered.
  • Investigate technical access issues.
  • Review billing mistakes.
  • Provide account or access help.

Opening a payment dispute without first contacting support may limit our ability to help and may be treated as evidence that you did not follow the agreed support process.

This section does not remove any rights you may have under applicable consumer law or card-network rules. However, fraudulent, false, abusive, or bad-faith disputes are prohibited.

8. Chargebacks and Payment Disputes

If you open a chargeback or payment dispute for a valid purchase or delivered digital service, we may contest the dispute.

Our dispute evidence may include:

  • Your account details.
  • Checkout records.
  • Payment records.
  • Proof that access was granted.
  • Login records, usage records, IP records, or access logs.
  • Your acceptance of these Terms.
  • Screenshots of the checkout, pricing, refund policy, and any purchase terms.
  • Support messages or evidence that no support request was made before the dispute.

If you file a fraudulent, false, abusive, or bad-faith dispute:

  • Your account may be suspended or permanently banned.
  • Your access to creator content may be removed.
  • Future purchases may be blocked.
  • We may provide evidence to Stripe, payment processors, card networks, banks, or relevant authorities.
  • You may be responsible for costs, fees, losses, or damages caused by the dispute where legally permitted.

If a payment is reversed, refunded, charged back, or otherwise not successfully paid, we may remove the related access immediately.

9. Creator Earnings and Platform Role

Backerz provides the platform, payment flow, account system, and access-control tools.

Creators are independent users of the Platform. Unless clearly stated otherwise, creators are not employees, agents, partners, or representatives of Backerz.

Backerz may process payments, deduct platform fees, payment-processing fees, dispute fees, refunds, chargebacks, taxes, or other applicable amounts before creator payouts.

Creator payouts may be delayed, withheld, reversed, or adjusted if there is suspected fraud, chargeback risk, policy violation, legal risk, or payment-processing issue.

10. Intellectual Property

Creators retain ownership of the content they upload, unless otherwise agreed.

By uploading content to Backerz, creators grant Backerz a limited license to host, store, display, process, and make that content available through the Platform.

Users who purchase or receive access to creator content receive only a personal, limited, non-transferable, non-commercial license to view that content through the Platform.

Users may not copy, download, reproduce, distribute, sell, leak, archive, scrape, or publicly share creator content unless the creator has clearly allowed it.

11. Platform Availability

We may update, modify, suspend, or discontinue parts of the Service at any time.

We do not guarantee that the Platform will always be available, error-free, uninterrupted, secure, or compatible with every device or browser.

We are not responsible for temporary outages, technical problems, payment-provider downtime, creator inactivity, or third-party service issues.

12. Third-Party Services

Backerz may use third-party services, including payment processors such as Stripe.

Payment details are processed by the payment provider. Backerz does not store full card numbers or banking details.

Your use of third-party payment flows may also be subject to the third party’s own terms and policies.

13. Limitation of Liability

To the maximum extent permitted by law, Backerz is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from your use of the Service.

Our total liability for any claim related to the Service is limited to the amount you paid to Backerz through the Platform in the 12 months before the claim arose.

Nothing in these Terms limits liability where it would be unlawful to do so.

14. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify users by posting the updated Terms on the Platform or through another reasonable method.

Your continued use of the Service after updated Terms are posted means you accept the updated Terms.
